ENACTMENT OF NEW LAWS IMPACTING SMALL CLAIMS
Effective January 1, 2003, Section 116.330(b) of the Code of Civil Procedure will require new time restrictions for service of process on a small claims complaint. The revised code section will require service of process on an in-county defendant at least 15 days before the small claims hearing date. A defendant who resides outside of the county must be served at least 20 days prior to the small claims hearing date.
Currently, the law requires the small claims complaint to be served at least 10 days prior to the hearing for a defendant residing in the county and 15 days for a defendant residing outside of the county.
Additionally, effective January 1, 2003, Section 116.570 will require that a small claims litigants seeking to postpone his hearing date file a written request at least 10 days before the hearing date. Presently, the law does not mandate a specific time period for a party to file a postponement request.
The amended code section permits the court to accept a postponement request failing to comply with the 10-day requirement only if the court determines that the party has good cause to file the request at a later date.

The 19th Annual East County Lawyer's Club Judge's Reception will be held on Wednesday, December 4, 2002 from 5:15 p.m. to 7:15 p.m. at the El Cajon Community Center located at 195 East Douglas Avenue in El Cajon. This popular event, which features holiday music, hor d'oeuvres and champagne, provides a unique opportunity to meet with judges and colleagues in a pleasant, informal setting. FOOTHILLS BAR HIGH SCHOOL HAS ANOTHER LOSING SEASON BUT AWAITS “WINTER PROM”
Once again Foothills Bar Highschool has progressed through another mediocre football season. The only bright spot has been our star quarterback, Dan Bacal, who once again set school records. He may be Foothills best athlete but his obsession with the cheerleaders has adversely effected his grades and he has little chance of receiving a college scholarship. Upon graduation Dan says he will be working as cashier at the local Arco station. It will be great to stop by, gas up, and reminisce with Dan about his great sports career at Foothills.
Dan isn’t the only disappointment. Principle Herbert Exarhos has gone on record to this reporter and says this Foothills class is the most disappointing of his career. He claims the class possesses no meaningful goals, morals or motivation. This reporter has attempted to interview students and teachers to gain some sense of whether Principle Exarhos’ dire statements are true. Drum Major and Chess Club President Garrison Klueck has stated that his sole goal is to not graduate from Foothills a virgin. Student body Vice President Ginny Johnson did not know what the word “virgin” meant. Her goal, of course, is to be the Winter Prom Queen. Fellow cheerleader, Kathy Marienau claims that Ginny has been held back for several years and therefore is too old to run for Prom Queen. Ginny counters by stating that her experience should count for something.
This reporter interviewed Home Room 6 teacher, Christine Goldsmith. Mrs. Goldsmith concurs that this class is an utter disappointment. She did, however, say that one student, Jack McCabe seemed to be a highly motivated and well mannered boy. She predicts that he will have great success and she believes that he is the type of young man who will never get into any trouble.
This reporter spoke with the only Sophomore cheerleader, Leah Boucek. Apparently this fine student will have to drop out school for “health” reasons. This reporter noted that she has gotten quite chubby this fall and the usually flirtatious student has become withdrawn.
Student body President Gary Glauser says he wants to be Foothills Prom King for 2003. He thinks it will cap off his stellar highschool career and additionally he plans to go on a two year mission after graduation and the crown will make a good reflector for his bicycle.
Newly transferred teacher, Alan Clements, and new teacher, Laura Halgren, have both attempted to put in their transfers to Principle Exarhos. This reporter was privy to a heated exchange between Mr. Clements and Principle Exarhos. The meeting was recorded as follows:
Clements: ”I want out.”
Exarhos: “Well, Mr. Clements, to paraphrase Hotel California, you can check in but you can never leave.”
Clements: “What are you talking about?”
Exarhos: “Haven’t you ever heard of the Eagles?”
Clements: “No, my musical interest stopped with Bob Dylan.”
Exarhos: “Well then Mr. Clements, let me put it this way.” “Do you know what a drag it is to be you?”
Clements: “Oh, then I guess I can’t transfer.”

President who has been consistently been the first to both volunteer and implement activities ranging from Padres Night, to seminars, to our Annual Dinner. Thanks also to departing Board member Sheryl Graf, chair of the Publications Committee, co-chair of the Criminal Law Section and a co-producer of the Annual Dinner....jobs all well done. Special thanks as well to Leah Boucek, who ably filled in for Dana Wynn and, with very little lead time, worked with Wells and produced a successful seminar in November dealing with Ethics, Bias and Substance Abuse. Leah is taking a year's leave from the Board to spend more time as homemaker. Lucky Boucek kids!
I am pleased to recognize our President elect, Bud Klueck, and the new slate of directors elected at the annual meeting of the Association November 26, 2002. Welcome to new members Andrea Schneider, Judy Marolt and Nancy Ewin. And, welcome back to Jerry Carmody, Dan Cohen Joe Fox, Jocelyn Medrano, Judi Klein, Sam Parise, and Ed Torrence.
The old and new Board join me in extending to all the members a special invitation to attend our annual dinner in January. We are all looking forward to the inaugural naming of the George Alspaugh Award, named in honor of our late colleague and to be conferred on the Association member who best exemplifies the civility and collegiality that marked George's practice for decades.
It was a very good year for Brown Bag Seminars, Section educational programs, dedicated volunteerism, and expanding support of all divisions of the East County Courts. We have suffered the tragic losses of several members, but with their passing, we have also gained new and valuable members and we continue to grow each month. I am confident Bud Klueck's term will be immensely successful. He is a good leader and an extremely hard worker. I wish him and the new Board for 2003 continued success.
Last in recognition, but certainly high in the rank of deserving, kudos to Catherine Tancredi and her continued superb efforts in compiling, editing and publishing our Newsletter. And also to one of our most dependable supporters, Rita Drouin . . . thank you for all your unsung efforts in helping the Association function smoothly and efficiently month in and month out. We appreciate both ladies.

Exarhos stopped him, put his hand on his shoulder and said, “you know the pump don’t work cause the vandal stole the handle.” “I know,” responded Mr. Clements as he slowly closed the door. (Note: There is no purpose to this above exchange except this reporter just likes to quote Bob Dylan.)
Teacher/Football Coach, Larry Brainard, seemed to be the only adult with an optimistic view of this class. Coach Brainard says that the football team has worked hard this year and even though the team tied the first five games and then got their annual butt thumping from the perennial powerhouse, Earl B. Gilliam Bar High School, Coach Brainard predicts victory in the last game of the season. The last game is of course with North County Bar High School. This reporter had a telephone interview with North County’s team captain, Skippy Throckmorton. He was quoted as saying, “This game will be a most excellent contest,” and further that he expects the competition to be spirited. Foothills team captain Jerry Carmody responded saying, “we’ll kick your ******* butts you preppie, cardigan wearing wimps. Captain Carmody, unfortunately, is suspended from that game because he was caught with defensive end Russ Robinson and Debate Team Captain Judy Klein, drinking under the bleachers. Judy Klein was not suspended from the debate team since she claimed harassment and that she was forced to drink the beer. School officials decided to back off any disciplinary actions against student Klein.
Ron Oberndorfer, Democratic Club President and school Valedictorian, has complained that too much attention is given to the “stupid” athletes. Ron, of course, is best known for being the only Senior still playing on the Junior Varsity tennis team.
No matter how dysfunctional this year’s Foothills class is, everyone agrees that they are looking forward to the big Winter Prom. The girls are, as always, looking for love and the boys will be looking for, well, you know, but everyone can’t wait for the big event. The band will be playing all the latest hits from Elvis, The Drifters, Chuck Berry and all of the big rock and roll stars.
The FBA Annual Dinner and Installation of the 2003 Officers and Board of Directors will be held on Friday, January 24, 2003 at the Singing Hills Country Club. The end of 2002 is fast approaching and schedules are filling up with extras like office parties and receptions. The purpose of this article is to discuss some items that should be routinely done at the end of each year as part of successful law office management.
1. Clients: review your open client list and close out dead files. Send a closing letter to each client and file a Notice of Withdrawal of Attorney if necessary. Review your current filing system and make sure that files are organized in a manner that makes items easy to locate and retrieve. Now is a good time clean out the files by recycling duplicate pleadings. Take old closed files out of the office file cabinets and store then in less expensive storage boxes and facilities. Once this is done, there will be plenty of room for files for the new clients the new year will bring.
2. Forms: review and modify as needed or create new form files. Review and modify as needed or create resource files of professionals, experts and legal information.
3. Billing: catch up on the billing and decide on whether to raise fees. Review Retainer Agreements as necessary. Review billing files and close out all those who have paid in full. Move these old closed files out of office file cabinets as well. Review all accounts receivable to determine which to send to collection or arbitration.
4. Bookkeeping: close out the year and review all bookkeeping information such as accounts receivable and accounts payable. Ensure that the Client Trust Account is audited and reconciled.
5. Tax Deductions: take advantage of last minute tax deductions by buying new office equipment (see computers, below), furniture, supplies or letterhead. Ensure that all law associations have been renewed. Donate old items to charity for a write-off.
6. Computer: analyze all programs and ensure that they are up to date. Analyze all hardware and ensure that it is up to speed to handle the programs and that the current systems configuration will deliver the most capacity affordable. Network if possible. Become connected to the internet at the office.
7. Staffing: create or revise personnel manuals. Create a 2003 Holiday office schedule. Consider giving a nice bonus to those who help us throughout the year.
8. Volunteer Work: review all involvement with volunteer work either as volunteer counsel or as a member of a Board of Directors.
9. Books and Magazines: clean out bookcases and recycle or store old books and magazines.
9. Vacations: the holidays are the perfect excuse to take a much needed rest. Schedule adequate time to not only close out the year but to rest and relax before the new millennium. Make sure a back up person is available and clients are notified in writing of the vacation schedule (with the December, 2002 billing statement perhaps). Vow to spend more time next year having fun. Schedule one or two long vacations next year. Also either take frequent short vacations throughout the year or small four day weekends every other month.
A well organized and efficient office can essentially run itself. This decreases our overall stress, raises our 'qualify of life' and allows us more time to not only take care of clients, but to spend time with those that count the most, i.e., our families and loved ones. It is easier than it looks. Happy holidays!

These are the third and fourth courses in a series of Alternative Dispute Resolution lectures encompassing Arbitration Advocacy, Mediation Advocacy, Elimination of Bias in ADR, Ethics in ADR, Drafting Effective ADR Clauses, and Drafting Employment Agreements.
